Americans for Prosperity Supports EPA’s Major Deregulatory Action
Americas for Prosperity (AFP) applauds today’s action by the Environmental Protection Agency (EPA) to bring the agency’s regulations in line with clear statutory mandates. Our common stance, clearly articulated by our sister organization, Americans for Prosperity Foundation, in regulatory comments filed in September 2025, has not changed: The EPA improperly used its standalone 2009 Endangerment Finding to “arrogate itself unilateral power to set national policy on a global issue” when that power properly belongs to Congress alone.
“An agency must operate within the framework of its statutory authority. With today’s action, EPA is doing just that,” said Faith Burns, Energy Policy Fellow at Americans for Prosperity.
By rescinding the Administration’s prior 2009 finding, it ensures the emission standards for relevant vehicles are consistent with the authority the agency has under section 202(a) of the Clean Air Act (CAA).
The EPA has also stated that if finalized, its proposal to rescind the endangerment finding would undo the underpinning of $1 trillion in regulations, with savings of more than $54 billion annually.
“EPA decisions impact our economy significantly. Today’s decision will have a positive impact not only on energy production, but on our economy,” Burns said.
EPA’s proposal received over a half million comments.
